Three of Obama’s Recess Appointments Removed From Office – Court Says “Unconstitutional”

Well, a bit of good news for America – the DC Court of Appeals has ruled three of Obama’s “Recess” appointments to the NRLB unconstitutional, and has removed the appointees and declared all of the orders from the NLRB for the last 12 months null and void. Just like they never happened.

And there may be more on the way…

In Noel Canning v. NLRB, the U.S. Court of Appeals for D.C. Circuit held today that Obama’s three recess appointments are in fact unconstitutional. As such, the three seats on NLRB were never legally filled. Thus NLRB only had two members, while the law requires three members on the five-member Board in order to have a quorum to conduct business or issue orders.
